Liability Waiver for The Hester Group, 2025 Renew and Thrive Wellness Retreat

THIS LIABILITY WAIVER AND RELEASE (the "Agreement") is entered into between The Hester Group ("Organizer") and the undersigned participant ("Participant") for participation in the Renew and Thrive 2025 Wellness Retreat (the "Retreatt").

In consideration of being permitted to participate in The Hester Group Renew and Thrive 2025 Wellness Retreat (the “Retreat”), I, the undersigned, hereby understand, acknowledges, agrees, to the following terms and conditions:

ACKNOWLEDGMENT OF RISKS

INHERENT RISKS: Participation in the Retreat involves inherent and unavoidable risks, including but not limited to:

Physical injury or strain

Mental or emotional stress

Illness or disease

Property loss or damage

Exposure to communicable diseases, including COVID-19

Other unforeseen risks associated with wellness activities and group gatherings

COVID-19 ACKNOWLEDGMENT: The Participant specifically understands that COVID-19 is a highly contagious virus that:

Can spread rapidly through person-to-person contact

May be spread by individuals who are asymptomatic

Can result in severe illness, long-term health effects, or death

Poses risks that cannot be completely eliminated in a group setting

VOLUNTARY ACCEPTANCE: The Participant knowingly, voluntarily, and freely assumes all risks, both known and unknown, associated with participation in the Retreat, even if arising from the negligence of the Released Parties (defined below) or others, and assumes full responsibility for their participation.

RELEASE OF LIABILITY: The Participant, on behalf of themselves, their heirs, assigns, personal representatives, and next of kin, hereby releases, indemnifies, and holds harmless The Hester Group, its officers, directors, employees, agents, volunteers, representatives, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, losses, damages, and liability arising out of or related to any injury, disability, death, or property damage, whether caused by the negligence of the Released Parties or otherwise, that may be sustained by the Participant during or in connection with the Retreat.

COVID-19 SPECIFIC PROVISIONS

COVID-19 is an extremely contagious virus that spreads through person-to-person contact. The Organizer cannot guarantee that the Participant will not become infected with COVID-19 during the Event.

Participant agrees to:

Follow all COVID-19 safety protocols established by the Organizer

Not attend if experiencing COVID-19 symptoms

Notify the Organizer if diagnosed with COVID-19 within 14 days after the Event

Accept the inherent risk of COVID-19 exposure in a group setting

MEDICAL CONDITION: I represent that I am in good physical and mental health and am physically and mentally capable of participating in the Retreat. I understand that I am responsible for informing The Hester Group of any medical conditions or limitations that may affect my ability to participate.

EMERGENCY CONTACT: I authorize The Hester Group to seek medical attention on my behalf in case of an emergency. I provide the following emergency contact information:

PHOTOGRAPHY & VIDEO: I grant The Hester Group permission to use photographs and videos taken during the Retreat for promotional and marketing purposes.

INSURANCE: The Hester Group maintains liability insurance provided by CPH Insurance. Participants acknowledge that this insurance coverage has limitations and may not cover all potential losses or damages.
